Welcome to SportyTok. These Terms of Service ("Terms") govern your access to and use of the SportyTok website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Please read these Terms carefully. They contain important information about your legal rights, remedies, and obligations. By accessing or using the Service, you agree to comply with and be bound by these Terms.
SportyTok Ltd. ("SportyTok," "we," "us," or "our") reserves the right to change or modify these Terms at any time and in our sole discretion. If we make changes to these Terms, we will provide notice of such changes, such as by sending an email notification, providing notice through the Service, or updating the "Last Updated" date at the beginning of these Terms. Your continued use of the Service following the posting of changes or modifications will confirm your acceptance of such changes or modifications.
PLEASE NOTE: THESE TERMS CONTAIN AN ARBITRATION PROVISION THAT REQUIRES ALL CLAIMS TO BE RESOLVED BY WAY OF BINDING ARBITRATION. Please carefully review the Dispute Resolution section below for details.
1.1 Age Requirement. You must be at least 18 years of age to access or use the Service. By accessing or using the Service, you represent and warrant that you are 18 years of age or older.
1.2 Capacity to Form a Binding Contract. You represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.
1.3 Compliance with Laws. You represent and warrant that your access to and use of the Service will comply with all applicable laws, rules, and regulations.
1.4 Geographic Restrictions. The Service is currently available in over 30 countries. SportyTok makes no representations that the Service is appropriate or available for use in locations outside of these supported countries. If you access the Service from locations outside of supported countries, you do so at your own risk and are responsible for compliance with local laws.
1.5 Prohibited Users. You may not access or use the Service if you have previously been banned from using the Service or if your account has been terminated for violations of these Terms.
2.1 Account Creation. To access certain features of the Service, you must register for an account. During registration, you will be required to provide certain information, such as your name, email address, and date of birth, and to create a password. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.2 Account Responsibility. You are solely responsible for safeguarding your password and for all activity that occurs on your account. You agree to notify SportyTok immediately of any unauthorized use of your account or any other breach of security. SportyTok will not be liable for any loss or damage arising from your failure to comply with this section.
2.3 One Account Per Person. You may not create or use more than one account. Each user is permitted to maintain only one active account. Creating or using multiple accounts may result in the termination of all your accounts and forfeiture of any accumulated earnings.
2.4 Account Verification. SportyTok may require you to verify your identity or provide additional information at any time. Failure to comply with such requests may result in suspension or termination of your account.
2.5 Account Termination. SportyTok reserves the right to suspend or terminate your account and your access to the Service at any time and for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease.
2.6 Account Deletion. You may delete your account at any time through the account settings page. Upon deletion, your account and all associated data will be permanently removed from our systems after a 30-day grace period. Any unredeemed earnings at the time of account deletion will be forfeited.
3.1 Permitted Use. Subject to your compliance with these Terms, SportyTok grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use.

3.3 Monitoring and Enforcement. SportyTok reserves the right to monitor your use of the Service to ensure compliance with these Terms. We may employ automated systems and human reviewers to detect violations. Violations may result in warnings, temporary suspension, or permanent termination of your account, at our sole discretion.
3.4 Service Modifications. SportyTok reserves the right to modify, suspend, or discontinue the Service or any part thereof at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
3.5 Service Availability. SportyTok does not guarantee that the Service will be available at all times or that it will be error-free. We may experience temporary interruptions due to maintenance, updates, or technical issues. We will make reasonable efforts to minimize such disruptions but cannot guarantee uninterrupted access to the Service.
4.1 Earning Mechanism. SportyTok allows users to earn rewards by viewing advertisements, completing surveys, and participating in other activities on the platform. The specific earning rates and mechanisms are described in our Earnings Policy, which is incorporated by reference into these Terms.
4.2 Earnings Formula. Your earnings are calculated based on the following formula: Earnings = (Ad Views × Base Rate) + Engagement Bonus + Referral Commissions. The Base Rate varies by region and ad type. Engagement Bonuses are awarded for interacting with ads. Referral Commissions are earned from the activity of users you refer to the platform.
4.3 Daily Limits. To ensure platform sustainability and prevent abuse, we implement daily limits on earnings. Standard users can watch up to 50 ads per day, while Premium users can watch up to 100 ads per day. These limits reset at midnight UTC.
4.4 Payment Methods. SportyTok offers several payment methods, including PayPal, bank transfer, cryptocurrency, gift cards, and prepaid cards. Available payment methods may vary by country. By requesting a payment, you represent and warrant that you are the authorized holder of the payment account.
4.5 Minimum Withdrawal Amounts. The minimum withdrawal amount varies by payment method: PayPal (£10), Bank Transfer (£20), Cryptocurrency (£15 equivalent), Gift Cards (varies by card type), and Prepaid Visa/Mastercard (£25).
4.6 Payment Processing. Payment processing times vary by payment method and are estimates only. SportyTok is not responsible for delays caused by payment processors or financial institutions. First-time withdrawals may require additional verification.
4.7 Payment Fees. SportyTok covers most withdrawal fees, but certain payment methods may incur fees as specified in our Earnings Policy. All fees will be clearly displayed before you confirm your withdrawal.
4.8 Tax Responsibility. You are solely responsible for determining what, if any, taxes apply to your earnings from SportyTok. SportyTok is not responsible for determining whether taxes apply to your earnings or for collecting, reporting, or remitting any taxes arising from your use of the Service. You are responsible for complying with applicable tax laws in your jurisdiction.
4.9 Earnings Adjustments. SportyTok reserves the right to adjust or reverse earnings that result from fraudulent activity, technical errors, or violations of these Terms. We may also adjust earning rates at any time based on market conditions, advertiser demand, or other factors.
4.10 Dormant Accounts. If your account is inactive for more than 6 months, it may be classified as dormant, and any unredeemed earnings may be subject to a maintenance fee or forfeiture. To keep your account active, simply log in and watch at least one ad every 6 months.
5.1 Referral Mechanism. SportyTok's referral program allows you to earn additional income by inviting others to join the platform. When someone signs up using your unique referral link, they become your referral, and you earn a commission on their earnings.
5.2 Referral Commission. You earn 10% of the base earnings from all users you refer, for as long as they remain active on the platform. Your referrals also receive a 5% bonus on their earnings for the first month.
5.3 Referral Restrictions. You may not refer yourself or create multiple accounts to generate referral commissions. You may not use misleading or deceptive practices to generate referrals. Mass referrals through spam or misleading practices violate these Terms and may result in account suspension.
5.4 Referral Link Usage. Your referral link is for personal use only. You may share it with friends, family, and acquaintances who would genuinely benefit from and enjoy using our platform. You may not:
5.5 Referral Relationship. If either your account or your referral's account becomes inactive for more than 6 months, the referral relationship may be paused until activity resumes.
5.6 Program Modifications. SportyTok reserves the right to modify or terminate the referral program at any time. Changes to the referral program will be communicated through the Service or via email.
6.1 SportyTok Content. The Service and its original content, features, and functionality are owned by SportyTok and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, "Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel," and arrangement of such Content, is owned, controlled, or licensed by or to SportyTok.
6.2 Limited License. Subject to these Terms, SportyTok grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service and to view the Content solely for your personal, non-commercial use.

7.1 Privacy Policy. Our Privacy Policy, available at privacy.php, describes how we collect, use, and share information about you when you use the Service. By using the Service, you consent to our collection, use, and sharing of information as described in our Privacy Policy.
7.2 Data Security. We implement reasonable security measures to protect your personal information. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.
7.3 Cookies and Tracking. The Service uses cookies and similar tracking technologies to track activity on the Service and hold certain information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of the Service.
7.4 Third-Party Links. The Service may contain links to third-party websites or services that are not owned or controlled by SportyTok. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that SportyTok shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
8.1 Service Provided "As Is." THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
8.2 No Guarantees. SPORTYTOK AND ITS AFFILIATES, SUBSIDIARIES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DO NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.
8.3 Earnings Disclaimer. SPORTYTOK DOES NOT GUARANTEE ANY SPECIFIC LEVEL OF EARNINGS. THE EARNINGS EXAMPLES AND ESTIMATES PROVIDED ON THE SERVICE ARE FOR ILLUSTRATIVE PURPOSES ONLY AND SHOULD NOT BE CONSIDERED AS PROMISES OR GUARANTEES OF EARNINGS. YOUR ACTUAL EARNINGS MAY VARY BASED ON FACTORS SUCH AS YOUR ACTIVITY LEVEL, ENGAGEMENT, LOCATION, AND OTHER VARIABLES.
8.4 Regional Variations. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
9.1 Liability Cap. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPORTYTOK, ITS AFFILIATES, SUBSIDIARIES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE.
9.2 Specific Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPORTYTOK ASSUMES NO LIABILITY OR RESPONSIBILITY FOR: (A) ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (B) ANY PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE; (C) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (D) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (E) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY; (F) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (G) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY.
9.3 Maximum Liability. IN NO EVENT SHALL SPORTYTOK'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT OF FEES PAID BY SPORTYTOK TO YOU DURING THE SIX (6) MONTH PERIOD IMMEDIATELY PRECEDING THE DATE ON WHICH THE CLAIM AROSE; OR (B) ONE HUNDRED POUNDS STERLING (£100).
9.4 Basis of the Bargain. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN SPORTYTOK AND YOU.
10.1 Your Indemnification. You agree to defend, indemnify, and hold harmless SportyTok, its affiliates, subsidiaries, partners, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your actions caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.
10.2 Cooperation. If SportyTok is subject to a claim that may be subject to indemnification by you, SportyTok may, at its option, (a) give you notice requiring you to defend the claim; or (b) itself conduct the defense, in which case you must cooperate with and assist SportyTok as requested.
11.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
11.2 Binding Arbitration. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration in London, United Kingdom, in accordance with the rules of the London Court of International Arbitration, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes.
11.3 Class Action Waiver. Any arbitration shall be conducted in an individual capacity only, not as a class action or other representative action. You expressly waive your right to file a class action or seek relief on a class basis.
11.4 Injunctive Relief. Notwithstanding the foregoing, in the case of infringement or misappropriation of intellectual property rights, breach of confidentiality obligations, or other matters for which injunctive relief would be appropriate, SportyTok may seek injunctive or other appropriate relief in any court of competent jurisdiction.
11.5 Time Limitation. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.
12.1 Termination by SportyTok. SportyTok may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
12.2 Termination by You. You may terminate your account at any time by following the instructions in the account settings page or by contacting us at support@sportytok.com.
12.3 Effect of Termination. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the account settings page.
12.4 Survival. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12.5 Forfeiture of Earnings. Upon account termination, any unredeemed earnings in your account may be forfeited. If your account balance is above the minimum withdrawal threshold at the time of termination, you may request a final withdrawal within 30 days of account termination.
13.1 Entire Agreement. These Terms constitute the entire agreement between you and SportyTok regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
13.2 Changes to Terms. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
13.3 Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
13.4 Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. We may assign or transfer these Terms, at our sole discretion, without restriction.
13.5 Notices. Any notices or other communications provided by SportyTok under these Terms, including those regarding modifications to these Terms, will be given by posting to the Service or by email to the email address specified in your account.
13.6 Force Majeure. SportyTok shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
13.7 Severability. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
13.8 Headings. The section titles in these Terms are for convenience only and have no legal or contractual effect.
